Terms of Service
These Terms of Service ("Terms") govern your use of PermitSmash, provided by Flintime Inc. ("Flintime," "we," or "us"). By accessing or using PermitSmash, you agree to these Terms.
1. Eligibility and accounts
- You must be at least 13 years old to use PermitSmash.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- Provide accurate information and keep it updated (including state and license selections).
2. Permitted use and license
Flintime grants you a limited, non-exclusive, non-transferable license to access and use PermitSmash for personal, non-commercial study of DMV permit materials. All content, questions, explanations, software, and branding are owned by Flintime or its licensors and are protected by intellectual property laws.
3. Acceptable use
- No copying, scraping, reselling, or redistributing PermitSmash content.
- No reverse engineering, circumventing security, or interfering with the service.
- No using PermitSmash to develop competing services or for automated testing of question banks.
- No uploading harmful code or engaging in fraud, harassment, or unlawful activity.
4. Access and availability
- PermitSmash currently provides learner access without gated tiers.
- Feature availability may change over time as the product evolves.
- We may suspend or limit access to protect platform integrity and security.
- Taxes or regulatory obligations may apply in some jurisdictions.
5. Account and service updates
- We may update service terms and feature sets with reasonable notice.
- You are responsible for keeping your account information accurate.
- We may pause or terminate accounts involved in misuse or abuse.
6. User content
If you submit feedback or suggestions, you grant Flintime a non-exclusive, worldwide, royalty-free license to use that feedback to improve PermitSmash without further obligation to you.
7. Third-party services
PermitSmash uses third-party providers (such as Supabase for authentication, and Google Analytics for usage insights). Their services are subject to their own terms and privacy policies.
8. Disclaimers
PermitSmash provides study tools and practice questions based on official DMV materials, but we do not guarantee you will pass any exam. The service is provided "as is" without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement. Some jurisdictions do not allow certain disclaimers; those disclaimers may not apply to you.
9. Limitation of liability
To the fullest extent permitted by law, Flintime and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or use, arising from or related to your use of PermitSmash.
10. Indemnification
You agree to indemnify and hold harmless Flintime, its officers, directors, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of PermitSmash or violation of these Terms.
11. Termination
- You may stop using PermitSmash at any time.
- We may suspend or terminate access for violations of these Terms or for misuse of the service.
- Sections that by their nature should survive termination (including ownership, disclaimers, liability limits, and indemnity) will survive.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and provide notice through the product or via email. Continued use after changes take effect means you accept the revised Terms.
